Terms and Conditions

The information contained within this document relates to Vasthare's online store, trading under Vasthare Coffee Private Limited.

Please read these terms carefully as they contain important information including warranty disclaimers and limitations of liability.

Definitions and Application

  1. In these Terms and Conditions, "Vasthare" means Vasthare Coffee Private Limited, 'you' means the organisation or individual who is ordering product on the website, and the "Products" means the Vasthare products which may be ordered on the website.
  2. These Terms of Trade apply to any purchase of any Products by you from this website.

Shipping and deliveries

Shipping is always complimentary for all orders. We aim to deliver our products to you at the place of delivery requested by you within the time indicated by us at the time of your order, but we can’t guarantee firm delivery dates or times.

Orders

  1. To submit an order for Products (Order), you must complete and submit the online order through the Vasthare website.
  2. Vasthare reserves the right to refuse any Order. In such case, Vasthare will notify you as soon as reasonably practicable and refund to you any payment in full.
  3. All products ordered are for personal use and gifting only. They must not be resold in any form or any place; Vasthare reserves the right to take legal action against unauthorised and unofficial sale of goods.

Prices and payment

  1. All prices on the website are in INR and do not include applicable sales taxes. The total cost including any applicable taxes will be displayed during check-out, once you have selected your billing and shipping address. Prices are subject to change without notice.
  2. The amount payable to Vasthare for an Order (Order Amount) will be the total of the following amounts:

    a. the sum of the price of each Product ordered as indicated on the website at the time of submitting the Order (Product Subtotal);

    b. the cost of delivery determined in accordance with Delivery stated above, and

    c. the sum of any other fees which Vasthare levies from time to time and which you have agreed to pay by providing your electronic consent (e.g. subscription fees).
  3. You must pay the Order Amount by credit card at the time of submitting the Order. Vasthare accepts Visa, Mastercard, or American Express.

Liability

  1. Without limiting Vasthare's legal rights arising from any failure by you to make a payment in accordance with these Terms of Trade, Vasthare reserves the right, in its absolute discretion, to take any of the following actions against you if you fail to make such a payment:

    a. withhold supply and dispose of the Products requested in the Order, and/or

    b. refuse to deal further with you, and Vasthare will not be liable to you for any loss or damage directly or indirectly resulting from any such action.

  2. Subject to clauses 8.2 and 8.3 and to the fullest extent permitted by law, the Products are sold and information is rendered to you on the understanding that you have sole responsibility for determining the suitability of the Products for the purposes for which you intend to use them.

  3. Subject to the following "No Warranty" clauses and to the fullest extent permitted by law, the liability of Vasthare for any loss or damage suffered by you as a result of Vasthare breaching its obligations under these Terms of Trade or other tortious duty (including arising by reason of defects in the Products) is limited to a refund or replacement of the relevant Products.

No Warranty

  1. Subject to the following clauses and to the fullest extent permitted by law, Vasthare gives no warranty in respect of the Products.

  2. For consumers the Products come with non-excludable warranties and guarantees under consumer protection legislation, such as that Vasthare is the rightful owner, the Products are reasonably fit for their usual purpose, are of acceptable quality, and match any description or sample. If Vasthare breaches any of these non-excludable warranties or guarantees, you are entitled, at your option, to a refund or replacement of the relevant Products, and to compensation for any reasonable foreseeable loss.

  3. You may also have express rights of action against Vasthare under consumer protection legislation if Vasthare supplied defective Products to you that cause you injury, loss or damage.

Force Majeure

If Vasthare is delayed or hindered in or prevented from performing any of its obligations under any Order by reason of any event or circumstance beyond its reasonable control, Vasthare will have no liability to you in respect of such non-performance and the time for performing the same will be extended until the event or circumstance has ceased.

Sales tax

Where Vasthare makes a Taxable Supply to you under or in connection with these Terms of Trade or in connection with any matter or thing occurring under these Terms of Trade and the consideration otherwise payable for the Taxable Supply does not include Sales Tax, Vasthare will be entitled, in addition to any other consideration recoverable in respect of the Taxable Supply, to recover from you the amount of any Salex Tax on the Taxable Supply.

General

  1. If any provision of these terms is found by a court of competent jurisdiction to be invalid, such term shall be severed and the remaining terms shall be unaffected (in this instance the parties shall use reasonable endeavours to negotiate a suitable substitute provision).

  2. Subject to clauses 8.2 and 8.3 and to the fullest extent permitted by law, these Terms of Trade together with the Order (as accepted by Vasthare), the Legal Notice on the website and Vasthare's Privacy Policy constitute the whole agreement between the parties and supersede all prior discussions and agreements between them.

  3. Orders and these Terms of Trade will be governed by the law applying in India, and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of India, and the courts complement to determine appeals from those courts, with respect to any proceedings that may be brought at any time in relation to these Terms of Trade.

Vasthare is committed to protecting your privacy. This Privacy Policy explains the types of personal information we collect, how we use that information, who we share it with, and how we protect that information.

What information is covered in this privacy policy

This Privacy Policy covers all personal information that we collect, use and process which means information that (either in isolation or in combination with other information) enables you to be identified directly or indirectly.

What personal information do we collect from you?

The types of personal information we may collect, and hold vary depending on the nature of our interaction with you and may include:

  1. identifying and contact information such as your name, postal and email address, telephone number, gender, date of birth and title;

  2. payment information;

  3. information ascertained about you from social media such as your profile picture, likes, location and friend list;

  4. geo-location details when using one of our mobile applications;

  5. product preferences and other information.

  1. Visit our website and register an account with us and/or purchase products through our website and/or undertake a live consultation;

  4. We typically collect your personal information directly from you.  On some occasions, we may collect your personal information from third parties such as payment platform providers

Why we process your information: To provide you with information about our products and services.

How we use your information for this purpose: We process your order history to develop, market, sell or otherwise provide products, services or information to you.

Based on the following justification: Using your personal information in this way is necessary for us to perform our contractual obligations to you. It is also in our legitimate interests to provide you with the best possible customer experience online and instore.

Why we process your information: To process your payments and protect you against fraudulent transactions.

How we use your information for this purpose: We process your personal information including your payment details (credit card, debit card and/or other payment details) to fulfil your purchase orders for our products, services and/or gift cards.

We also process this information to keep your payment details safe and protect you against fraudulent transactions. We process details of your device when you shop on our website to enable us to detect any fraudulent transactions or suspicious purchasing activity.

Based on the following justification: It is in our legitimate interests to process personal information to keep payments secure and necessary for the performance of our contract with you. Providing us with certain personal information is voluntary but we may not be able to process your order and send you the required order acknowledgement and shipping confirmation e-mails if you do not provide us with certain requested information.

Why we process your information: To provide you with products and services that you have purchased from us.

How we use your information for this purpose: We may need to use your name and contact details to perform our obligations under a contract with you (e.g. where you have purchased a product or service from us, like a hand cream or a facial treatment).

Based on the following justification: It is necessary for us to process your personal information in this way for us to perform our statutory and/or contractual obligations to you.

Why we process your information: To learn more about why you use certain products and inform our product developers.

How we use your information for this purpose: We process your individual distinctions, experiences, and insights (e.g. skin type or an adverse experience) to update your account with us.

We also process this data to conduct internal administrative activities, research, analytics, planning and product development. If you have a customer account (whether created online or in-store), we may also collect information about the products you browse online or purchase, where you purchased the products from and other information relevant to your customer relationship with Vasthare. We use this information for our internal demographic insights into our customers, to offer you an enhanced service according to your preferences, including by identifying relevant products, services and events which may be of interest to you, and to personalise your experience with Vasthare.

Together with non-personal information, we may also use this information for our internal marketing analysis and demographic studies, to analyse, profile and monitor customer patterns so we can consistently improve our products. This means that we can offer more personalised and integrated shopping and interactive experiences to our customers across all our channels.

Do we use your personal information for direct marketing?

We will only use your personal information with your consent to send you marketing materials by email, text, WhatsApp or post, depending on your marketing preferences. Our marketing communications may include the products, services and other offers of Vashare or of third parties who have a relationship with us.

You can opt out of receiving direct marketing from us at any time by contacting us as described below. When we send you direct marketing communications by email or other electronic means, we'll always give you the option to unsubscribe in the message itself.

How do we protect your personal information?

We do several things designed to keep our data secure, including administrative, technical and physical safeguards such as firewalls and encryption measures.

While we endeavour to protect our systems, website, operations and information against unauthorised access, use, modification and disclosure, due to the inherent nature of the Internet as an open global communications vehicle and other risk factors, we cannot guarantee that any information, during transmission or while stored on our systems, will be safe from intrusion by others, such as hackers.

How long do we keep your personal information?

We will only retain your personal information to the extent permitted by applicable laws and regulations. When we no longer need to use personal information, including for any contractual, legal, or regulatory requirement, we will remove it from our systems and records and/or take steps to anonymise it so that you can no longer be identified from it.

How do we deal with children's privacy?

We will never knowingly collect personal information from individuals under the age of sixteen (16) years. If we become aware that a person under 16 has provided personal information to us, we will remove such personal information from our files.
